Advancing Justice Affiliation Submits Formal Comment To DHS Urging Them To Rescind Proposed Rule, And Protect Asylum Applicants Who Rely On Work Authorization

On April 24th, 2026, Asian Americans Advancing Justice, a network of four independent Asian American civil rights organizations, submit the following comment urging that the Department of Homeland Security rescind its February 23, 2026, Proposed Rule (“PR”) which would severely restrict asylum applicants’ access to an Employment Authorization Document.

The design of the PR suggests that its true purpose is not administrative efficiency but rather, the closure of the U.S. asylum system to those who seek its protection—an impermissible motive for agency action under the Administrative Procedure Act.
